Rights & restrictions

Title restrictions, servitudes and zoning

Several independent instruments can constrain the same property.

What to check

Zoning controls land use and development under the scheme. A title condition is a registered restriction. A servitude protects a specific right over land. Estate rules and municipal approval conditions may impose further limits.

Your next step

A planner and conveyancer should establish the source of a restriction before seeking its removal or amendment. A rezoning cannot be assumed to remove a title condition, and an approved building plan does not prove that every restriction has been resolved.

Useful supporting information

Keep existing rights, title information, decisions and approved plans together. Share deadlines and the intended proposal before selecting an application.

Use the service finder and document checklist, compare quotation categories, or read the original Tshwane sources.
